Litigation
The firm devotes
substantial resources to its litigation matters, most of which are
large and complex, and works to obtain the best result for our clients.
Kaplan Fox thoroughly prepares every case for trial and will not
hesitate to go to trial to vindicate our clients' rights. However,
because the outcome of any trial cannot be predicted with certainty,
where appropriate, we are willing to explore the possibility of
a pre-trial settlement on terms favorable to our clients.
Securities Litigation
Over the past twenty
years, the firm has represented numerous clients in the highly-specialized
area of securities litigation, including class action securities litigation
and shareholder derivative actions. Kaplan Fox has recovered hundreds
of millions of dollars on behalf of aggrieved investors in cases where
the firm acted as lead or co-lead counsel.
In cases brought under federal and state securities laws, Kaplan
Fox typically represents investors who purchased securities at prices
that were artificially inflated by a company's false and misleading
statements or omissions. In an appropriate case, we seek redress
not only from the company and its principals, but also from others
outside the company who have participated in the fraudulent conduct.
Related to these types of securities cases (which are often brought
as class actions) are shareholder derivative actions, in which a
shareholder brings an action on behalf of the corporation to redress
harm to the corporation, such as corporate waste or mismanagement.
For example, Kaplan Fox has successfully represented shareholders
who have brought derivative claims against a company's board of
directors for failure to maximize shareholder value in the context
of a merger or acquisition.
Antitrust Litigation
For nearly thirty
years Kaplan Fox has represented clients in actions brought under
federal and state antitrust laws. These cases, which are usually
litigated as class actions, are typically brought by businesses
and individuals who have been injured as a result of price-fixing,
customer allocation, or other anti-competitive behavior by manufacturers
or sellers of particular products or services. Kaplan Fox lawyers
have been at the forefront of several of the most important private
antitrust actions over the past three decades, having been appointed
by federal and state courts as co-lead counsel or member of an executive
committee in numerous antitrust cases. Over the years we have
recovered hundreds of millions of dollars for clients.
Consumer Product Litigation
Kaplan Fox has recently
expanded our litigation practice into the area of consumer litigation.
This area of practice focuses on the representation of victims of
a wide array of misconduct concerning the manufacture, testing,
sale or marketing of products. For example, the firm represents
individuals who have been exposed to potentially harmful drugs,
as well as people who have purchased automobiles with certain defects.
General Litigation
Although
the bulk of Kaplan Fox's litigation practice is concentratrated
in the areas mentioned above, the firm's experienced lawyers regularly
handle a wide variety of other matters involving common law fraud,
employer/employee disputes, contract claims, intellectual property
and bankruptcy issues.
Real Estate and Trusts & Estates
Kaplan Fox has a long
history of representing the interests of individuals who live in this
country and abroad, who purchase, sell, develop and finance real estate
in the United States.
The firm also offers a full complement of estate planning services, to assist in the orderly transition of assets. Our experienced estate
and trust attorneys have handled many complex estates in various Surrogate's or Probate Courts. In this area of our practice, our clients consist of many generations of families who have come to rely on our probate and
trust experience. In addition, we represent numerous clients in the publishing field and assist professionals in negotiating practice contracts and partnership agreements. We are also experienced in the field of art
